Time limits for scaphoid fracture claims
As standard, you have three years to make a claim for any type of medical negligence, including in relation to misdiagnosis or late diagnosis of a scaphoid fracture.
This time limit is counted from the date when you are aware of the fracture and that medical negligence may have occurred. This is known as the ‘date of knowledge’.
There are some circumstances where a longer time limit may apply. For example, if the claim relates to a child, the time limit only applies once they turn 18, so you will normally have until your child’s 21st birthday to make a scaphoid fracture compensation claim.

Scaphoid fracture medical negligence success stories
£42,500 in damages for 12-year-old’s missed scaphoid fracture
Our scaphoid fracture misdiagnosis solicitors acted for the family of a 12-year-old girl who suffered a scaphoid fracture in her right, dominant wrist after a fall.
Although she attended A&E and an X-ray was carried out, the fracture was misdiagnosed as a sprain and appropriate treatment was not provided. The claimant was seen again in A&E some months later as the wrist was still painful but, in spite of a review of the original X-ray, the scaphoid fracture was missed again.
Three years later, the girl’s wrist because extremely painful and she was unable to write. She was eventually referred for a new X-ray and physiotherapy, at which point the fracture was discovered. A review of the original X-ray showed that the scaphoid fracture had been visible when the girl first visited A&E, three and half years earlier.
The delay in diagnosis meant that surgery and a bone graft were required to fix the damage and that the girl will never regain full flexibility in her wrist. She has also been left with an increased risk of osteoarthritis and the potential to need arthrodesis or fusion of the bones in her wrist at a later date.
We represented the family in their claim against the hospital. They admitted fault for failing to diagnose the scaphoid fracture and offered £25,000 in compensation. We were able to negotiate a higher settlement of £42,500, which the family accepted.
