Boy Wins Compensation for Injuries Suffered at Birth

The family of an eight-year-old boy who suffered devastating brain damage during his birth, due to the admitted negligence of hospital staff, have succeeded in obtaining a compensation package worth £9.5 million to pay for the lifetime of care he will need.

The boy suffers from cerebral palsy as a result of a culpable delay in his delivery and has been left with a range of physical and learning difficulties. The NHS trust which ran the hospital where he was born admitted that he had received sub-standard care and issued an unreserved public apology after admitting liability in full.

After extensive negotiations, a settlement of his claim was agreed, which includes a £3,725,000 lump sum. The boy will also receive annual, index-linked and tax-free payments to cover the costs of his care for life. Those payments will start at £125,000 per annum until he is aged 12, before rising to £155,000 per annum until he is 19. They will then increase again to £186,000 per annum for the rest of his life.
