Time limits for cauda equina claims
In most cases, you will have three years to make a claim for cauda equina compensation.
This time limit is counted from the date when you first become aware that you have cauda equina syndrome, that diagnosis and/or treatment was delayed due to medical negligence and that this has resulted in harm to your health. This point is known as the ‘date of knowledge’.
However, in some circumstances, you may have longer to make a claim. For example, if the claim relates to a child, the time limit comes into effect once they turn 18, so you will normally have until your child’s 21st birthday to make a cauda equina compensation claim.
