Time limits for birth injury claims
You will normally have until your child’s 21st birthday to make a birth injury compensation claim.
However, if they are deemed to lack the mental capacity to pursue a claim on their own behalf, there is no time limit to claim.
For birth injuries to the mother, you usually have three years to claim from the date where you were aware of the injury and that medical negligence may have occurred.

Birth injury medical negligence success stories
£75,000 for family of brain damaged baby due to failure to deliver earlier
Our birth injury solicitors acted for a 28-year-old woman whose baby died at the age of 6 months after suffering oxygen deprivation during birth.
The woman had attended hospital to give birth after starting labour. During the birth, medical staff failed to properly watch and interpret the information provided by birth monitoring equipment, thus failing to realise that the baby was experiencing oxygen deprivation and that a caesarean section should have been ordered.
The baby was born with severe brain damage due to the prolonged lack of oxygen to his brain and, sadly, he died aged only 6 months old.
Our team represented the family in their claim against the hospital and were able to agree a settlement of £75,000 in damages.
